How would you not pass a visual emissions inspection? Not every car has a second set of CATs..
Because the inspection station should have a list of exactly what emissions controls the specific car they are inspecting should have on it when they enter the make/model/year into their computer.
How else could they possibly do the inspection, given the differing array of emissions hardware cars have had on them in the last couple decades.

Well, it's still illegal in FL, you just have no real way of being caught...
It just doesn't make a lot of sense to me to mess with the cats for 1-2 hp though... on my previous car, which made a lot more power than anything discussed in this thread, removing the cats was a bit more of a gain so it was worth the trouble (plus that car was loud as hell anyway so making it slightly louder wasn't an issue)
