She didnt win cause she spilled the coffee on herself, she won cause the coffee was hotter then it needed to be and caused burns that could have avoided.

I suppose I should have answered my own question. It would probably only be a negligent entrustment issue, assuming that his friend who was driving had a known propensity for reckless driving. Until BadAssGS3T’s insurance company says they are ready to right now to cut an $80,000 check, let them worry about defending. Any demand by the injured party is probably going to be for some big dollars, or policy limits, which ever is less.

That being said, where is his friends insurance company? Does he have any?

You said that the insurance comp. gave you agood offer,Are they going to pay you asettlement for the car and let you keep it? or buy it back from you stock??

Yes, he has insurance but my insurance told me that his insurance would only come into play if my insurance is not enough to cover damages claimed by the other party..

I spoke to my lawyer and he told me that I should not lose sleep over this. I guess I will just have to wait and see.

They bought it back from me stock. In fact, they have already picked up the car. I just listed the engine and electronics for sale in the classifieds section. I thought I had a buyer but I have not heard anything else from him.
