Hybrid malfunction
All fixed! My problem turned out to be a defective turbo valve, which was repaired in 1 day. Dealer support was excellent and I'm relieved they were able to pin this problem down. Gas mileage went up and my starts are smoother now, also.
From wiki: A wastegate is a valve that controls the flow of exhaust gases to the turbine wheel in a turbocharged engine system. The diversion of exhaust gases regulates the turbine speed, which in turn regulates the rotating speed of the compressor. The primary function of the wastegate is to regulate the maximum boost pressure in turbocharger systems, to protect the engine and the turbocharger.
Just to build on what @Urlik said:
If a wastegate sticks OPEN, the turbocharger can not spool up and provide the desired power.
If it sticks CLOSED, too much pressure (PSI) will be applied to the combustion chambers...and that could damage the engine.

I was recently playing with the instrument displays, and there is a boost gauge available there on the 500h, which would help determine what the specific issue is
I took my new 500H on one road trip and it failed at 4,000 with Hybrid System Failure. It's been in the shop waiting on a transmission control module (TCM) for 8 weeks. The new part came in this week, damaged, and they have to order another one. They have no idea when another part will arrive and it might not be the root cause of the issue, I'm told. It's been sitting in the hot Texas sun for 8 weeks (normally garaged) and that can't be good on the interior. I went from BMW to this car, thinking it would be a reliable car. Not the case. I don't have the car I paid for and I wish I had never bought it!
Visited the dealer yesterday to retrive my belongings after they said part eta is now 8/17 citing the part (transmission seal) has not been manufactured yet
so today i started a lemon law lawsuit with a group that specializes in this matter.
in NY you can start the lemon law if one of the two or even both of these situations occur
1. vehicle has been to the dealer 3 or more times for the same problem.
2. Vehicle is at dealer for repairs for more than 30 days
i fall into the 30 day category. It has been close to 90 days
lawyer said i will either be heavily compensated or i will get a brand new replacement.
i would rather get my money back so i can go back to my silverado jmho
so today i started a lemon law lawsuit with a group that specializes in this matter.

Ask for a buyback, they can resell this car after they repair it (on their time, not yours) so it should mean nothing to them. Then you can either get into a new one or just walk away, maybe get on the list for the new Land Cruiser if you want something more rugged.
