OK. I have been reading the different threads about some of the rattles, etc. some of the new '06 GS owners have experienced. I also understand that this is not the majority.

My scenario is this:
The '06 GS was introduced about a year ago so the pre owned / used inventory is growing.
I never by a car brand new and was going to purchase a pre owned '06 GS with 8-12k miles on it.

IF for some reason I did purchase this car from a dealer/auction/private party and found it had the same annoying rattles, etc. would I lose any recourse with the dealer because I would be the 2nd owner or would I be able to demand the problems be fixed as well?

Factory warranty is 4 years/ 50k. The issues will be covered under the factory warranty. And if you buy CPO, you'll have an even longer warranty.

However, the biggest factor will be the level of service you get from the service dealership. Some dealers go out of their way to please their customers. Others, not so much.

I have had the infamous rattles as well, but the dealership fixed it under warranty
and I am very happy with the car right now. As INHOCJP pointed out,
the 06 GS should still be under Lexus factory warranty and some dealerships are
better than others

I would say it depends. It depends on the consumer protection laws of the State where you live or from where you purchased the vehicle. It would also depend upon whether the vehicle is purchased from a Lexus dealer. It might even depend on the previous history of the vehicle. Above all things, READ the contract, warranty, and any disclaimers.

huh? It does not depend on customer protection laws at all, but if car is under warranty.
"Customer protection laws" will not help you with dashboard vent giving you an creak.

Safest thing in any case would be to buy CPO vehicle...

i DOUBT THERE WILL be CPO gs300s with 10K miles, CPO is done to attract buyers so they have a considerable and attractive warranty on the car. Say car had 30k miles and was an 05 or 04....

Huh??? The question did not refer to anything specific, like a dashboard creak and, yes, consumer protection laws are relevant to this question because of so-called "lemon law" protection. Being under warranty does not necessarily mean that the problem will (or even can) be corrected; if the problem persists, at some point the buyer will grow tired of taking the vehicle to the dealer under the warranty. A warranty is not a magic wand and some problems cannot be cured under warranty protection; moreover, warranty service can vary depending on the dealership. After almost 26 years of practicing law I stand by my response.

I have been told rattles and squeaks are considered "adjustments" and are covered under 12 months 12,000. From my experiences with CPO, they do NOT cover this type of problem. I would ask the question

My dealer worked on rattles well past 40k miles on my last GS. Guess it shows that the level of service varies by dealership.

So, if you were in my situation -- with a six-month old GS that has been in three times for a total of almost 25 days of service which allegedly will be fixed by tomorrow -- would you guess that you might still have a lemon law buyback case, even if it has just been rattles? (I'm in Calif, you're in Maryland, so perhaps you can't comment).

Events that trigger "lemon laws" are recurring problems or defects occurring within a certain period of ownership that repeated attempts to cure (by the manufacturer/dealer) have not solved or fixed. I am not a California lawyer, but I recall that California is considered as one of the leading jurisdictions for protecting consumers. Having a new car in the "shop" for the same repairs 25 out of the first 180 days of ownership would not appear to be an expected or reasonable occurrence.
