Default Calipers broken???

Since last week, I have been hearing clunking noise every time my right rear tire hits any sort of bumps at over 30mph, which gradually become louder and I took the car to the shop to see what's wrong with the car.
It happens that one of the screws has broke and left stucked in one of the caliper.

Does anyone know the cause of these?
I dont think the dealer changed the pads when I went in for the brake pad TSIB (2006 IS350).
car is 43k miles as of today.
Does anyone think I could get reimbursements from Lexus?

the right side is broken

the other corresponding hole has a screw stucked in it.
