Take my advice: remove the cover on the charcoal cannister housing and look for rotten or rotting vacuum hoses.

Well; the thing is the shop thoroughly looked through everything top to bottom and they found nothing wrong after 5-6 days of thorough testing. But I will inquire with the shop to see if they checked the hoses that you are referring to. I cant do this myself as i do not have jack stands or the equipment to do it. The shop did not charge for labor for anything as we have a "arrangement" of sorts where they agreed not to charge labor unless there are part(s) that need replacing.

Matt:

There is good bit of writeup on the code and pending codes in the having problems start here sticky. There we have documented to log the error code and clear it and wait for it to come back.

Intermittent problems are very hard to diagnose and one has to make a guess as what is the weak part. If one has deep pockets then you can preemptively replace components and hope you have hit the right thing.

Best is to wait till you have a hard failure and when you replace the bad part the problem goes away.

You got a good break from the shop as they invested their time and did not charge you. The shop owner would still have to pay the mechanic (+ rent of the property). If the owner and mechanic are the same them he is simply investing in customer relationship.

Well; its not a problem financially for the shop as its part of a huge group of "shops" that have a huge financial backing from their corporate office and so they can afford to do that w out a problem. I will look at the stickies and see what i can make of it.

I don't know why this would take 6 days. The diagnostics are pretty straightforward.
Once cleared the code will not return immediately, but the drive cycle before it is reported is also well defined.

It sounds like you are unable to test this yourself and you took it to an independent without success.
Might need to try the dealer.

I didnt come out and say dealer right away because i had a feeling all i would hear is moaning and groaning about it from people. As for the code; well so far the cel has not come back on at this point thankfully; but if it does; and it pops the same code; then i will have to go back to them(dealer) again
