Your right, at lot of states plug into your OBD-II connection and inter your car into their computer system. Our State use to be a mandatory fail if you had a "check engine light".
About 3yrs ago they made a lit "check engine" light no longer a mandatory pass/fail, now they just listed it as information for you.

Do all stand-a-lones set off CEL's?
