I have an '07 and it has the emblem on the trunk. I don't know about other years, but I'm sure others will chime in. If the other years all have the emblem, then I would be concerned that the car you are looking at may have been in an accident and the auto body shop didn't replace it.

After the 2011 LS, all Lexus models do not have the stylized LEXUS badge on the rear. So if you are buying the newer 2013 LS, you won't see the LEXUS badge.
My guess for them taking out the badging is because of greater brand recognition of the big L. Prior to the 2013 GS, I am guessing most people were still not 100% sure what the L badge stood for. It also could be to further themselves from the mainstream Toyota cars. I might be wrong, but Lexus was the only major luxury brand to have their name on the back of cars. Mercs, BMWs, and Audis all just have their corporate logo. I didn't count Infiniti because they are not as global yet.
P.S. I am not talking about the big L that is on the front grille of the car. If you guys look at pictures of any Lexus LS prior to 2011, you will see the badged LEXUS word on the upper left hand corner of the trunk. Other models have it also on the left hand side, but not always on the top.
