I have had this happen and what you do is file the claim with your insurance and let them know all info. You pay for your deductible and file with your insurance to get
fixed. Your insurance company goes after her for the cost of repairs as well as your deductible. It took State farm 1.5 years but one day I got my 500 deductible check in the mail when they filed on the person that hit me in the parking lot. This person had no insurance as well soooo. Call your insurance agent and explain it and go get it fixed where you want to. Let the insurance agent deal with this person.

The main reason why I have all kinds of insurance is to protect what I have in the bank. A simple lawsuit could easily wipe away everything you have spent your whole life saving in an instant. I pay in excess of $20K a year in all the types of insurance I have for that sole purpose. People are very litigious these days and you would be surprised at what kind of lawsuits people win these days. Most of these comments were an attempt to look out for you or to be aware of something you may not and educate you not to shame or look down on you.

Just wish you the best of luck and hope that nothing ever happens to you whether it is your fault or not. I've had several friends with cancer that live very healthy lives and was of no fault to them. That's easily several hundred thousand right there per person in treatment and medication.

My attorney told me of an example that happened to a client of his. His client hits a pedetrian at an intersection, his liability was a 100k if I remember correctly. He crippled the pedestrian and in the end it cost him over 800k for damages and it crippled him financially. He strongly suggested I get an umbrella policy and I heeded his advice. If one keeps rolling the dice not having insurance, you'll eventually get bit one way or another.

In my case, my RC was fixed in 1 week and I got my deductible back and the whole case closed in just under a month.

Curious if the body shop will end up finding that your headlight was damaged as well. That's a $2,500 part. Good luck OP. That sucks.

If the lens is not cracked, headlight mounting tabs cab be plastic welded. Also for the top 2 tabs that usually break, Lexus sells replacements and there are two hols for the screw to go into the headlight. I bought my triple beam led headlight from a wrecked car and replaced the top tabs with the oem replacements.
