If your gut is telling you something isn't right, I'd go with that. Get some answers or ask for your deposit back.
I saw my name on the list in his computer screen. It shows the color and the car details with 2023 by it. I don't have anything in my writing though. I am sure its gonna be a few months. They take the money only to put the name on the list. The final pricing will be given once they have the clarity which they should have had by now.

More 2023 ES's are showing up on cars.com. Still not ULs. Some F-sports though.

The likely culprit is due to a Mark Levinson audio chip shortage. ML sound isn't a standard feature on any model or trim. So unless specially ordered which Lexus is still not accepting, most Luxury and Ultra Luxury trims will likely include ML sound as part of that dealers auto template for their Lux's and Ult. Lux. builds. Due to that reason you will likely not see many if any for a while.
