I would need to see some proof of that. I have a feeling when you look you will see there are no specific laws that say you cannot drive barefoot. If cops don't like it or it makes it less likely for them to let you off is a question that's hard to answer, but whether or not it's "illegal" or not we can answer.
You're correct.....there are no specific laws that I know of, either. I thought I made that clear. But the practice, like I said, is generally frowned on. It's more or less like driving with a BAC of 0.78 or 0.79....which, though not illegal, would be just short of the widespread 0.80 limit for a DUI/DWI charge.

Anyway, its not a practice I am likely to stop any time soon, as my feet swell when driving long distances, and wearing shoes physically hurts. As for city driving, 99% of the time, I am in flip flops from april to november and then from november to april I am in my boots.

If you're referring to my comment, I wasn't directly comparing barefoot driving to then effect of driving DWI. I've driven barefoot a couple of times myself after my knee surgery, when I couldn't put my right shoe or sock on and off normally. I was refering to a comparison on how cops treat issues that are of borderline legality.

I have a cop friend who's been in the force for many many years. He's never ever ever heard of giving a ticket for driving bare feet in California. Ever. Hahaha
I have to agree with the statement that driving at 0.079 is not illegal. Something is either illegal or it is not illegal, I agree with that. Its fact. Police are supposed to deal with facts.
Driving a car with no shoes on is not illegal anywhere in North America.
I think driving in flip-flops is worse than driving barefoot, FWIW...
My best driving shoes are probably my Vans, since they have fairly thin soles, providing decent feel, but are still fine to walk/stand in for a decent amount of time.

I've driven with flip-flops many times, especially during the summer, with no problem at all. Where I got in trouble with them is going down stairs....they can slip, break, work loose, and cause a major fall......that's why I had to have knee-surgery last year.
