on labor day (9-3-12) i get a phone call from a neighbor informing me that an ambulance had just backed up into my car and destroyed my front bumper, actually taking if apart and crippling my fender. i hurry down and cops are already on the scene. my car was parked legally and was the first after the crosswalk. i'm so upset, the incompetent driver just kept apologizing, the cop made an accident report and i'll be picking up @ the precinct on thursday.
anyhow, my story is my insurance lapsed by 4 days, i understand NY is a no fault state but can i make the claim with the ambulance's insurance directly since i can't obviously involve mine or are the repairs coming out of my pockets?
i took pictures and a video as well as 3 witnesses and their pertaining info.

I believe you can work with their insurance directly. If you had insurance, you would have a choice and could go through yours and then have them pay you back, or go through theirs. I dont see a problem with just going through the amburance's insurance. They should be the ones contacting you.
somebody should add "ambulanced" into urban dictionary, defined as, "when your car is backed into by an ambulance"
If your car was parked it and not moving then you should be okay. Even if you don't have insurance because you are 100% not at fault. So rather you having insurance wouldn't change the outcome, you would not have to do the fighting or leg work.

Anyway, doesn't matter if your insurance lapsed or not, since it's the other party's fault, you don't wanna go through your own ins anyway. Just file a claim with the other company and they will cover all the cost including car rental.

If NY is a no fault state, except for limited exceptions, you CANNOT go after the other driver's insurance company, and you MUST claim against your own insurance--that's the whole point of no-fault. I don't think letting your own insurance lapse is one of the exceptions to no-fault. You really need to get confirmation of this, though.
You don't even need to get your insurance company involved. This has happened to me mulitiple times over the years.
Its a simple case of property damage, once you get the police report, call the other insurance company and file a third party claim. You are also intitled to a rental while your car is being fixed.
