That's where my point is.......if you don't have full coverage, your own insurance would not pay you, your only option is to take it to court against the driver/owner which their insurance will take care of.

My friend was in one of those 50/50 accident and he only got pay 30% after he peruse it to court.

Couple of year ago (I don't have full coverage), I was rear-ended by a un-license driver on highway, its 100% the their fraud and written on the police report. Their insurance sent a guy to quote the damage. When I submit the claim, their insurance company refused to even start the claim and states its the non-license driver's fraud and I should peruse after him. I'm totally shock!! I filed small claim against the driver and the car owner because I was no-fraud. Within 2 week they received the court summon, I received a check in the mail with 100% of the insurance quote.

But I think, since this a insurance court, if im not found at fault, than they will sent the other parties insurance the notifaction and they would have to pay for it.

EXACTLY! Not that Im yelling but yea... If you have one way insurance basically you have to do your own foot work. I.E file your own claims and sue the person or their insurance yourself. The other person's insurance will compensate you for your damages. Than in the BostonVp's case you have to then fight the cituation in court to get it off your record. So you won't have that ding against you and then you are made whole. Game over.

Ive just call the rmv about the citation hearing, they said that they have receive my court fee now just waiting for the court to set a date for the hearing. Hopefully everything is goes according!

Just got a notification from the citation court after one long wait and its gonna be a ANOTHER MONTH long wait..they schedule the hearing on the first of September, guess summer gonna be crusieless =\

HELLO EVERYBODY!

Been a while, but i finally have some answers! So i went to appeal in front of a judge on the 4th of Nov, and they found me not responsible for the citation! It felt amazing, almost did a backflip, but thought to myself, your in a court house, remain calm, haha! Also spoke to a lawyer earlier, we went through the files and everything, and right off the back he said i have a really good chance of winning, but i dont know wah to do, if i have a good chance of winning, should i just do it myself, or have him represent me, what do you guys think!?
