Given your 2 choices I would go w/ the used 7 series w/ a good warranty. If you really wanted an ES350 I would wait a few months after the '08's come out to make sure the transmission problems are fixed.
What I really think you should get though is either an '06 GS300 or a little older LS430 for that money
For a little more $ you could get an '07 GS350.

Maybe you otta look at your needs and go from there. Do you have another vehicle in your household aside from the GS? Could you use the utility of an SUV instead of another sedan? Or a truck? Or would you prefer something sporty and with two doors?

I'd definitely take a 7 series over an ES, that's not even a contest
