Default Hypothetical Question?

If two cars are racing, or just tailing each other above the speed limit, and the rear car notices a cop behind him, so he changes lanes to let the cop pass, the cop pulls up to the car and points at him, and even appears to possibly be beckoning you like he's pissed, then proceeds to about 5 or so car lenghts to the next car, and then hits his lights at this point for the first time, mind you, the rear car is behind the cop and the lead car. The rear car exits the highway, while the cop and lead car are still on the hwy inaccessible to the rear car. What can the cop do about that? Even if he got the plates, but he never turned the lights on behind the rear car, nor onside of the rear car, is there any action he can take?

Already happened to me, I was the "rear" car. The only difference is that the cop did actually hit the lights on me and made me pull all the way over as if he was going to stop me. He then proceeded to speed off and get the lead car. About a mile up the road I see the lead car pulled over and the cop ticketing him. I think he was trying to make a point like: "I could have, if I wanted to".

how so? an officer posed with this question said, if he wanted you, he would'a radio'ed and had his friends come get you, or sicked the helicopter on ya.

Are you wondering if the cops can give the person in the rear-car a ticket even if they didn't pull him over? I don't think they can because they need your signature on the citation so you "promise to appear" in court.

that was my thought, but then I was wondering about like the instance of Photo radar ( which none was being administered ), of how they mail tickets to the registered owner. Another person said he and another vehicle ran a red light, and the officer hit the lights behind both of them and they went seperate ways and the officer followed the other car, ... nothing happened to him ( yet ).

In California, the legislature enacted a law allowing tickets to be sent home in the case of red-light cameras, but for everything else you need to be pulled over. I'm quite sure it's the same in TX.

well, I would generally say if he didn't hit his lights behind you, you are (barely) in the clear. Talk about walkin tha tightrope!!
