Man Down
6 months ago i flew from miami to texas to buy the sc300 that i looked for on the internet for months and drove it back. it all went well for 6 months when 2 weeks ago a guy decides to make an illigal left turn right infront of my 100% perfect 2000 sc 300 {black on black, il have you know...} so i get the guys insurance information, call them up and make a claim . i called them every hour on the hour to keep the whole thing moving along. the apraiser came out and told me it was totaled. today the "total-loss" adjuster calls me and tells me that my car is worth 13950 and anyhting i can show a reciet for I.E. the brand spank tires i just put on the drilled and sloted rottors and the new battery. fine i payed 14 and put 20,000 miles on it il brake even maybe make a little, no problem......then about an hour later she calls me back and tells me the guy was only insured to 10,000$ and they cant give me anything more then that. so now i have to pay back my 6500$ i still owe on the car and im left with 3500......... now im lost. i dont know what to do. i went from a sweet *** ride to now il be lucky if i can get a sweet 92 tercel..... how can this happen .... what should i do?
It won't be anything like a 2000 black on black, but you can find an older SC300 for $3500.
EDIT: and yeah I would get a lawyer if they told your car was worth X amount and wanted to give you less. When a guy t-boned my old Eclipse GSX, they told me it was worth $5000, and when they looked and found out I only paid $3300 for it they wanted to give me that much - I don't know what my dad said to them but they gave me the $5000.

Well what if he's only insured for 10 000$? guess what your car is worth more than 10 000$ so he should be paying the extra cash... not you. well I'm happy that around here you can't be insured for a special amount, you're either insured or not...
I live in Florida also what I would do is file through your insurance company then let them deal with the other persons insurance bs. I did this when the person that hit me comitted fraud on thier insurance and the company didnt want to pay. I has to front the 500 dollars for my deductable but when my insurance got the problem straight I got the money back. Less headache but took alittle longer. Just my take.

SECONDED!
File a claim with your insurance carrier. They will pay for damage to your auto, then subrogate against the other drivers insurance carrier. You'll still hafta pay your deductible which I assume is 1K or less. Like Hurley said, much less hassle.
To those who suggest hiring a lawyer....I think that would cost as much as he is trying to recover anyway, unless you get some bargain-basement attorney.

if you know any local shops that might **cough cough** give you receipts for thing that u **Cough cough** did to your car in exchanged for sum $, and take him to court, things like new trans timing belt replacement. if u have the receipts they will most likely pay you for the them. see if u can at least break even maybe even put sum $ in your pocket. Was that the 2000 Sc with 40K? Damn if it is I was going to buy it.....O well sorry to hear. Lawyers usually takes 33% of the winnings. If your car was totaled I would think that you have some sort of "medical" problem and need to go to the chiropractor etc....it builds up to a good sum.
