sorry about your loss man,but what's most important is your health in this unfortunate situation... you live another day to dust off and get back into the game!.... it sounds like you may have a very good case.it probably would be in your best interest to go to therapy for your ailments, and contact a lawyer to deal with other matters. hey, get your insurance money and get a newer sc!

Wish you well. As long as you re alive and well, your open to new options! GOOD LUCK

I would recommend you get your neck pain check out in a month, I am not a doctor but I think it will get you later. I am still feeling my pain from an accident in 97

My '93 SC400 looked almost identical to yours and I had the same injuries.. None.

I hope you get better soon and good luck with your case. It should be an easy victory.

Default law

I've been told the law as change in NJ, you can't sue anyone in a automobile accident unless you have broken bone(s). Does anyone know if this is true?

If this is true, its ludicrous. What if you get a serious concusion, whiplash, torn ligaments, sprains etc. That's worthless if its true. Hopefully you can AT LEAST get your health care covered by this guy and have him get you in a new ride.

I can't speak to the broken bone issue (just doesn't sound right), but whether you can sue or not depends on whether you ticked that little box on your insurance form about "right to sue" (and paid the higher rates for it )

Glad you're okay. I hope you sue and get compensated for all your pain, property demage, and more. At this point I wouldn't go through the insurance. I highly doubt there would be any law taht prohibits you to sue anyone for an accident.

If you did go through the insurance, make sure you tell them how much pain was inflicted to you. All the cuts, truama (seems like you experienced fair share); absolutelly tell them everything. Including complain about your neck and back because there is a 99% chance you will experience problems in the future.

Don't feel sorry for the person that has caused this accident. It is normal for a victim to symphatize after some form of truama. It was his fault. Also make sure your insurance company decides it's 0% your fault. Don't agree or anything more than a 0%. It's a way for them to say we don't want to pay.

That's why you shouldn't sign that waver or go through the insurance in such cases.

your SC gave it's life for you...

happy that you're not hurt any worse. i also recommend hiring a lawyer if you're hurt at all. also go see your doctor just to make sure everything is ok.

OMG. On the way home I almost killed my SC3. I was caught in a snow storm and spun out on the highway hitting middle guard rail lightly. The bumper is a little scratched but everything else is fine. You can actually barly see it. I have to say I am so lucky.

I made two complete 360 deg. spins toward the edge of the highway (edge of the bridge) but regained control by going sideways through the turn. Unfortunetly after the turn was over I couldn't streighten out and was still going on a 45 deg. angle so I hit the brakes and slowed down. I ran out of a few inches and hit the guard rail.

It really felt like playing some car computer game. I didn't panic and controlled the spin so I don't think I did too bad.

I think from now on I will start driving my beater and not take a risk with the SC.

Chris
