The law is not exactly as you stated. The law states if wipers are in continuous use, such as due to rain or inclement weather which is defined as:

“A condition requiring the windshield wipers to be in continuous use due to rain, mist, snow, fog or other precipitation or atmospheric moisture.”

If it is dark enough the lights will turn on regardless.

In either case this is a non-issue as the operative word is “continuous.”

I apologize for oversimplifying, I did not perceive it to be an issue, only to make a discussion point, not compare state and federal regulations.

Some IS and GS (RIP) models have an "Auto" button on the windshield wiper stalk.
Wipers are basic intermittent on startup and you must tap the Auto button to enable the sensor.
Pro: your get to choose. Con: You have to choose each time you drive.

You can customize the wipers to be the old school intermittent only and turn the Auto feature off. It is a dealer configuration.

I did the configuration because most states don't require headlights on when driving in the rain, and I honestly didn't want to use up the headlight bulb for no reason. I just told them to reconfigure it at the lexus dealership and they happily did it!
