Default pre owned sales question

When a licensed Lexus dealership inspects a vehicle prior to sale and they find defects, such as brakes, or during a test drive the steering wheel has a "shimmy." Are they required as a reputable dealer of Lexus fine automobiles required to correct such issue prior to sale. And lets say hypothetically they tell the buyer that they have fixed these isssues that they discovered at inspection and noted by the serice department as recommendations on paper work given to the buyer, like "replace rear brakes" and then the buyer purchases the vehicle and discovers that the lexus dealership in fact did not do the work that was recommended by the service dept or correct the "shimmy" as they claimed, are they not responsible for making the needed repairs?

wow, a bit wordy. The dealership isn't liable at all, unless the vehicle was sold off the lot and part of what you agreed to in writting. I know up here in BC the Lexus dealership has to ensure it is 100% road ready and must fix all safety issues.

Privates sales just allow for a negotiation to take place in the buyers favor if the seller cares to listen.

Like any dealer, a Lexus dealer can sell a vehicle "as is." Is there a 30-day warranty or anything like that? If you have in writing that the repairs were done or were promised to you, you have them where you want them. I bought my daughter's RX used at a Toyota dealer, and they fixed the shimmy at my request (balancing the wheels did it) before I took delivery. I hope any promised work really was done to your car. It's so hard to go back and get some places to do anything. Talk to the used car sales manager if needed. Good luck!

Look at the purchase contract. That is the binding agreement. AS IS trumps all good, bad, incomplete and never carried out repairs. Some state laws may give the purchaser more rights.

Know your situation and then give the dealer a call and see what they can do to make you a happy customer.

The dealership can fix the problems, if the fix is cheap and they can still make a ridiculous profit on the car; or they can sell it "as-is" and make almost as much; or, if it's in really bad shape, they will wholesale it (and still make a healthy profit). Either way, the dealer wins and the seller (and buyer) loose!

I prefer to call them "used cars" 'cause that's what they are!
