update... I replaced the 8 capacitors in the ecu and the car is back to normal. The power no longer cuts out when the pedal is pressed past a certain point.
YAY! - eventually I am gonna convince everyone to do this!!!

There came another successful LS400 owner changing Nichicon PF(M) capacitors. The same thing can be said to Toyota car owners who have late 80s and 90s.
