Good luck. Diminished value is hard to prove and no idea why they'd make your car payments when you'd have made those even if the accident didn't happen. Just be happy if the repairs are done properly.
For me, diminished value was as hard to prove as asking my insurance adjuster about it and waiting a couple of weeks. I didn't have to do anything. Just saying, it is worth a shot.

Ya I haven’t had too much troubles proving it up in the past either. Insurance companies always balk on the front end when first brought up for sure, but worst case you order a couple of diminished value reports, compare ‘excellent’ KBB/etc values, and if you have to get firm purchase offers from local dealer and/or Carmax to show what true market value is for the car with its damage history.
In my jurisdiction, there is zero ability to get diminished value under your own policy. You have to sue the other person. Even then, it's, rightly, thought to be speculative in most cases since the value isn't fixed and may well be zero.

They need to pay diminished value AND make your car payments for you.
Ya it was outside a doctor’s office. Poor lady was heavily medicated and admitted she shouldn’t have been driving, but was nice enough to come back inside to find the owner.
Really only good options in this situation, given the rental offered wasn’t anywhere near roughly equivalent, is to pursue both diminished value and loss of use claims (loss of use being approximated by the cost to rent a similar type car rather than the monthly car payment). On top of the cost to repair obviously.

One had the most disgusting center console I have ever seen and the other had clearly hit something and damaged the bumper and fender. But what can you expect from someone that had a disgusting interior with a box of Trojan condoms sitting in the back seat…
It’s a shame that so many people don’t take care of what they have yet there’s people like me that would love to have an IS500.
