Foucs on the fact that she was going over the speed limit or what was safe for conditions, as the "she should have seen me and avoided me" option doesn't work. My EX was T-boned and like you the question was brought up "why didn't she try to avoid hitting me?" Well, ultimately she/you were in their travel lane and they hit you entering their lane.

I hate bushes like that. I see them everywhere. They serve no purpose other than to dangerously block your view of oncoming traffic.

 

I don't get how this accident happened. It sounds like you were entering a mall roundabout and you 'pulled out a little' and she smacked you. If so, how was it a front end collision? Seems it should have been a hit in the left front quarter panel rather than a frontal crash. Just curious on the dynamics of the crash.

 

yeah i was pulling out a little so i can see so i had the steering wheel turned left see over the damn bush so pulling out the car was facing the street a little if that makes sense

 

So after talking with the collision place today looks like they are saying there going to total the car now there sending the paper work to the insurance and waiting on what they want to do
