do you take out the second filter when using a k&n drop in filter?

The 2nd filter as in the one in the top of the upper chamber? No. That's permanent and non-replaceable.

thanks for reply. does it ever get dirty where it will need changing like a stock filter?

No, it's there as part of the emissions system...do not remove unless your state could care less about emission. Cough cough, SC! LOL
