Default warranty issue

hi,
if lexus couldnt fix the noisy problem from the car, and still under warranty, wouldn't be possible to have a new replacement car?

It would depend what the "noise" is--it would have to be pretty bad. They would not give you a new car if they couldn't fix, say, a dashboard rattle.

I assume you meant to say "wouldn't"

Although laws vary by state, normally lemon law buybacks are done for customers with serious problems affecting safety and/or driveability, that are unresolved after a reasonable number of repair attempts.

Take it back again to get fixed, while still under warranty.

LOL - there is no way a dealer will give you a new car for a noise complaint (what's the noise, anyway?). Half the people on this forum would have new cars if that was the case!

I agree with everyone who said to keep taking the car back to the dealer until you're satisfied.

We have had people try and get Toyota to take back cars here for simple rattles or noises (which we can't even hear or duplicate!)....it NEVER works....

I purchased an IS250C just over a year ago. Within 3 months, the roof started to rattle. Not just your normal rattle, but an annoying rattle. Took it in. They didn't fix it.

Took it back, they moved the rattle from the front of the top to the side. Took it back. They then adjusted stuff and the roof was no longer flush. The rattle then moved to the back.

Took it back. They tighted stuff, added padding, blessed the car, all sorts of stuff but they couldn't get rid of the damn rattle.

The last time I had it there, they had it 8 days, had a tech ride in the trunk, put 80 miles on the car and still couldn't fix it.

Early June this year, Toyota purchased my vehicle back. Got a good Lemon Law attorney and the rest is history.

I now have the Infiniti G37 Convertible. Great car but being a convertible, it does have a small rattle. That's acceptable. The rattle in the Lexus went beyond acceptable.

^^ Wow...sounds like you just had a BS tech working on your car, or a writer who was not smart enough to get a manager involved...comebacks are a serious thing at a service department (well, at least mine), and if something doesn't get fixed right the first time, it goes straight to a team leader (master tech) and gets handled...

Sorry to hear about your loss...must suck to see all the IS350 taillights!!! JK

i already took the car back to lexus for 5 times, and the service manager said, they already done what they can. and he sent the report to head office to contact toyota japan, and ask me to wait a month.
the problem is there are some clicking noise come from the front dashboard. and happen when have a long drive, or high speed. but only happen once every 15 mins.
and i found out it does happen on the 2 load car, when they fixing the car for me.

With T & L having issues now, maybe they would be a little more accommodating. G'luck.
