I always think about situations like this - if you do not have a witness, how do you prove that this truck actually damaged your car. It could be your word against his and it might go 50/50...

I would assume that the insurance companies dropped everything because it was a he said she said battle with no witnesses present. Sucks because you have a Lexus with some noticeable damage and I'm pretty sure the driver of the semi doesn't give a crap about any damages on the 18 wheeler. I usually stay clear of any over sized vehicles, LOL!

Traveling these crazy roads each week across the south, truckers always win. As much as it pains me, I ALWAYS get out of their way. You should have too.

Sorry to hear about the damage OP.

I bet the truck driver was probably thinking "my truck is bigger and he's in a nice car... he has to let me go"

Anyway, I wish you the best of luck. I think you have a good shot at winning this claim becuz the truck driver pulled a hit and run.

If the truck is in the main lanes and the OP was merging the trucker has the right of way. Most people don''t know how to merge, they barge in and expect the traffic to make room for them rather than adjusting their own speed and entering at the highway speed when safe to do so. And from a practical point of view this is akin to bringing a knife to a gunfight. Don't tangle with an 18 wheeler, you have no chance.

Nothing new in the way of news here. I guess OP's insurance company wasn't impressed with the story.
