I had to push the hood down, to get out of traffic.... and since it was driving.. I guess I thought I could get it home. I was less than two miles away. I thought i could just get it home. But I guess the computer shut down or something because it just died.. So I justpulled over and waited for the tow truck

Were you distracted as well? Why weren't you able to stop in time? I'm sure the stopping distance of a SUV is much longer than the stopping distance of the GS. Were you tailgating? She can use that against you when she speaks to the insurance company.Originally posted by Rockero28

Not to bash you or anything, but in almost all cases, if you rear-end someone it's almost always your fault. You should have called the cops so a police report can be filed with her comments that it was her fault. But that's too late.
Hopefully she's an honest person and will admit guilt to her insurance company. But even if she does, the insurance company may tell her that it wasn't her fault since SHE didn't hit anyone. They'll tell her that it's the guy in the Lexus that hit HER.
I think she told you it was "her fault" so that you won't be upset. While you're gone, I bet she called up her insurance company and told her that a manic driving a Lexus all of a sudden rear ended her when she was a complete stop.
Since no police report was filed, it's her words against yours. And since you're the one who hit her, I think her insurance will no be willing to fork out too much $$$$$$$$.
Dealing with insurance companies (especially if they're not YOUR insurance company) is a PITA! You will have to convince the adjuster that it was HER fault that caused this accident.
Well, as I she said, she admitted and accepted it was her fault. ole me her insurance would pay for my car since her car was not damaged. Also the insurance company said they were sending out an adjuster tomorrow, so that is why I think they will take care of it. She panicked. She over reacted. She is the one that was dista=racted and slammed her breaks.... Probably the kids in her car. You know how that goes. And I was not ditracted. I was not on the phone or otherwise... But, I look at it this way. If I got into an accident, and my vehicle was not damaged, but the other person's was, and it was a scenario as mine where she slammed on her breaks. You say that is it almost always the other person's fault... then why would she make a claim, admit it was her fault, offer to pay, and all that? I could see if there was damage to her vehicle. But why would she nmake a claim if there was no damage? You know her rates are going to go up. I know I would not if I were her. I would be like, hey it's your fault, your damage, and you deal with it. Be lucky I don't come after you.... So it does not make sense other than she accepts responsinility and her insurance is going to cover it right??? Also, if they were not going to pay... why would they send an adjuster to see my car for repairs? I would think that if they were not going to do anything, they would tell me that they weren't and that they were not going to pay for my repairs. I may be wrong, I neeever had an accident so this is the first time. I am just going by what has happened so far.?

Sorry to hear about that accident. I totaled my car last May, so I know how you feel. Where in California are you? I am in San Diego, and I like those CHEVRONS in your display. I was a GUNNY myself. Did 23 before I retired 10 years ago.
I really hope things work out like you said, because usually rear-end collisions are the fault of the person who ran into someone from the rear. You are a very fortunate guy if the other insurance company takes responsibiblity and actually fixes your car. Very fortunate indeed.

Sorry for the unfortunate mishap but glad that neither you nor anyone else was injured. As others have already said, in most cases of rear-end collision the driver of the 2nd car is the one deemed to be at fault. Even if the front car stops for no reason at all, stops abruptly, etc. The duty of each driver is to operate his vehicle with sufficient control that he can avoid a collision in the event of unexpected occurances such as the car in front executing a panic stop on the interstate. Now, if she had defective equipment such as no lights or inoperative brake lights or so on, then you have some mitigating factors that may get you off the hook. I have never heard of any insurance company paying a claim for an accident on which no police report has been filed. They will probably require that one be filed even after the fact. The other driver's admission of guilt may only carry limited weight for determining fault. The police (Hwy Patrol) and the insurance company will make a definitive determination based on the facts. Chances are they will contact YOUR insurance company after reviewing the case and inspecting your damages especially if it turns out their insured discovers that her vehicle has some previously unappreciated damage or she develops some delayed symptoms as a result of injuries sustained. Its always a good idea to notify police after an accident BEFORE you leave the scene.
