Often when I push the button to open the trunk lid it opens part way and the drops, usually hitting me in the head as I get stuff out. It doesn’t fi it every time and won’t at the dealer. Tell them your attorney's watched the clip of it hitting you win the head and maybe they should reconsider? Or tell you're going to file a NHTSA defect case. Seriously though, how often does it do it? Every third time, tenth, totally random? I'd tell them to keep it and just keep trying it. Sometimes it's best to let the dealer have the car for a few days in order to replicate the situation if it's an intermittent one.

Escalate the issue within Lexus. The procedure is in the warranty manual and was cited recently in another thread.
As long as you have documentation that you presented the problem to the dealer while under warranty, they should fix it after the warranty expires assuming the problem persists/gets worse.
This has also happened to me a few times. The trunk lid will start to come up but stops about midway, It happens so seldom I just didn't worry about it too much.
Bit of a thread hijack, but I've wondered about my trunklid with the spoiler on it. That obviously makes it heavier; I wonder whether they adjust the strength of the lift mechanism in any way to hoist the extra weight. If I had to guess, I'd doubt it. That makes it doubly interesting that some people's trunk lifting mechanisms aren't getting the job done if they DON'T have the added burden of the spoiler.
