You may want to share the name of the other fellow's insurance company, so that we may avoid them. You may also want to let that insurance company know what you are doing on the internet. The internet is a powerful negotiating tool.

Really sorry to see this, and sorry for your pain, what a nightmare. I hope you are able to get it right real soon. Look into diminished value as mentioned above, because it will show up when trade up.

I truely feel for you as I was rearended in April 2011 in my 2010 ES. I only had the car about eight months and had about 6,000 miles on it. I was ROLLING along a road close to my house and the speed limit was 35 and I was driving between 35-40 and a guy come up behind me and hit me. He told the cop that he lost his vision due to the darkness and the trees.....yeah right. He got a ticket for failure to control speed and no inspection sticker. They drive crazy every day here in Houston. I am glad he had insurance. They paid for my rental, repairs to my car, my deductible and dimished value. He had to be towed home.....I think when he hit me it must have broke a water hose or something cause fluid was leaking out.....well good enough for him since he hit me. I am thinking seriously about getting the new 2013 ES. I may do it in the next few weeks. I have a co-worker that has asked about mine. He knows I take really good care of my cars. I only have 20,000 miles on mine but I do like the new one. Anyway take care.

I missed your post earlier but still wanted to tell you to take the "diminished value" deal seriously. My son had a real minor - rear bumper skin only - accident in a 2012 Mercedes E350 a few months ago and had it repaired by a quality (expensive) shop. We talked about diminished value and I told him he would have a hard time with that with such minor damage. When he finally saw the light and went for a GS350 in December only one dealer out of four would even consider taking the car in trade and then at a sharply reduced value because of the CarFax report even though he had pictures, the repair order etc. So now he, like me, leases his cars.

How did your settlement work out?

I've got a CarFax story for ya.

I was trading my Audi in on my '11 ES350. The dealer ran a CarFax and it showed my car as being in an accident. I told them that I had never been in an accident with my Audi then I realized.

A few weeks after I bought my Audi, my wife backed into my car (front fender) with her then Chevy SUV while coming out of our driveway...mine you that both vehicles were in my name. I contacted the insurance company so I could get the repairs done. Never even considered this incident would be put on a Carfax report.

And a second CarFax experience: A few years ago I had an Infinit\y with maybe a 3/8 inch paint damaged door ding in the driver's passenger door so it bothered me. I went to an Infiniti dealer body shop and they said the only repair would be to repaint the entire right side of the car at a cost of over $2,500. I of course, couldn't go with that so I drove the car another couple of years before trading back to a Lexus. When appraising the trade-in they came back with a CarFax report showing "unrepaired colllision damage" or something to that effect. I showed them the "unrepaired damage" and we got back to business. But be cautious about even asking some shops for an estimate. I don't even think they gave me written estimate before reporting that item to Carfax.
