I've learned to be just at the absolute egde of what's legal, otherwise I seem to get pulled over for the po-po entertainment. As much as I like talking to the local law enforcement, I can really do with out the monthly check-ups.

I say 2. Doesn't seem like bikes really get pulled over that much anyway...

#1 all the way. Do not give the po po a reason to pull you over bc then they take it as an opportunity to try & find something wrong (ie, do u mind if we search your vehicle?) w/out just cause.

This is the reason I had to remove my license plate frame as my state has just announced a new law & I did not need flashing red & blue lights behind me.

Does your state have a rule that plates must be mounted vertically and unobstructed? In that case, both options may be illegal. I ask this because states are getting prickly about license plate mounting, surrounds, and covers in order for automated plate readers to work.

The language of the law in California is actually quite simple and straightforward:



Division 3, Chapter 1, Article 9 » Section 5201

Positioning of Plates

5201. License plates shall at all times be securely fastened to the vehicle for which they are issued so as to prevent the plates from swinging, shall be mounted in a position so as to be clearly visible, and shall be maintained in a condition so as to be clearly legible. The rear license plate shall be mounted not less than 12 inches nor more than 60 inches from the ground, and the front license plate shall be mounted not more than 60 inches from the ground.
And:

Division 3, Chapter 1, Article 9 » Section 5201.1

Obscuring Readability of License Plates: Prohibition

5201.1. (a) A person shall not sell a product or device that obscures, or is intended to obscure, the reading or recognition of a license plate, as prohibited by subdivision (g) of Section 5201.

Position 1 follows both laws sufficiently.

Position 2 breaks Section 5201.1.
