Unmarked cars: Yes. They just have to identify themselves properly. They can be doing an undercover operation or something. Unlikely, but they can, just like how cops can give you a ticket on a bicycle or horse.

Off duty Officer: No. The Police Department is no longer held accountable if something happens while the officer is off the clock. Imagine if something happens when the officer shoots a suspect because the suspect had a gun -- the Department is no longer held accountable because the officer was off duty...

Show you a badge or point a gun... It enough ID for most people.

Yes, I have been pulled over by an undercover ICE agent. His Glock 50mm was enough ID for me !

What I find odd is the off duty cop didn't call for an on-duty one. Usually what they do is pull you over while off duty and wait until the on-duty cop comes and writes you up.

To be honest they can do whatever they want and clearly have shown in court, they can get away with it by being found innocent countless times.

If he was off duty i would just wave my hand to him and say "See ya later"....no, plus i dont think he would waste his time trying to bust you and risk possible aggression when he's off the clock.

if a random guy in a random car pointed a gun at me i would speed up, not pull over...and a badge can be as fake as $2 oakleys...

o and do u mean .9mm because 50 mm is basically a artilery shell... and .50 cal will make your undies brown....

+1. A while ago somebody post about a cop(real cop) pull over the vehicle and stole the guy money out of his valet while checking his id.

in CA i believe its illegal to be given a TICKET by an unmarked and/or un-uniformed cop.

40800. Every traffic officer on duty for the exclusive or main
purpose of enforcing the provisions of Division 10 or 11 of this code
shall wear a full distinctive uniform, and if the officer while so
on duty uses a motor vehicle, it must be painted a distinctive color
specified by the commissioner.

This section does not apply to an officer assigned exclusively to
the duty of investigating and securing evidence in reference to any
theft of a vehicle or failure of a person to stop in the event of an
accident or violation of Section 23109 or in reference to any felony
charge, or to any officer engaged in serving any warrant when the
officer is not engaged in patrolling the highways for the purpose of
enforcing the traffic laws.
