Rear brakes question

I have tried to push it with my hand and it has not moved. The guide is misaligned now that the pads are thicker. I'll try again. Is it common that the caliper did not simply swing down into alignment?

I got it. That entire guide slides in-ward so that it is aligned.

What should I torque the 12mm bolt to? What would happen if it is too tight? How would I know that it is too tight without a torque wrench?
