2009 is250 rwd surging while in motion

2009 is250 rwd surging while in motion
Hello,
I'm looking for some help and I will provide a history and present problems that I'm experiencing. In February 2013 my IS250 was surging at idle and I deemed this unsafe. As a result my IS was taken to the dealership in which they ran unknown tests and deemed the vehicle to be fine- I did not agree with this result but I really didn't have any recourse.
Fast forward to the past two days, my IS is now surging while the vehicle is in motion. Yesterday with 7kms of my house the vehicle surged 6 times and then the symptoms disappeared. The roads were dry so poor-traction is not the issue. I was using the gas pedal normally
Today within 7 minutes of start-up my IS surged twice within a minute. On this time I was using cruise control so my foot was not even on the gas.
I have another appointment for this issue in which I would like to get this problem resolved as I believe this is a major safety issue.
My IS at 51K kms on it.
Any help would be greatly appreciated,

Update, My is remained at the dealership for a week as I had an ES loaner. To this end the only issue that Lexus notices that the CIA where the cone filter attached was loose. Other than that the vehicle was operating within spec.
I think the fact the vehicle was at the dealership for a week is a little devious. Can anyone provide some insight?
