Not sure where you heard it, I never heard this complaint relating to this particular transmission in any professional review. I do happen to have the IS with the 8-speed and definitely can't blame it for 'busy shifting' or 'changing its mind'.

I'm also surprised that's the complaint you've heard as I've yet to run into the gearbox being confused.

My biggest issue is how tall the gearing is; the only gears I feel like I get power out of are 2nd, maybe 3rd, and 5th. I like to joke that it's an 8 speed that's been geared like a 5 speed.

Higher gears are for highway driving, I get plenty of highway power (also for passing) at 6 & 7 th gear. The gears are actually nicely spaced, close to 15-20% between two adjacent gears, no abnormal gaps.
