. If you have data and texting disabled in your account, no matter the phone, it won't work. As far as I'm aware, they won't automatically put you on a data plan. You will be able to use wifi.
I haven't tried connecting at a wifi spot without a SIM but I don't see why it wouldn't. Take the phone to the local coffee shop without SIM installed and see.

Depends how you want to view this though. If you are an ATT user and you do not have data/text, when you pop in your ATT sim you will get ding for it. ATT searches for an IMEI once it boots, which is how they get you. If you have the phone unlock for a different carrier or pick up a gophone sim that would be the only way around it for now.
