If it's your photo, you hold the copyright to it and should tell the seller to take it down. Just because it's on the internet doesn't mean you can use it for whichever purpose you please. Since the seller is using the photo for business/profit, it doesn't fall under fair use.

the internet is considered a public domain.
so if you don't copyright it with those stupid words over the image, I believe it is fair game to use.
some toothpaste company did that a few years ago and they got away with using pictures that people posted on facebook.
*note* facebook has then since changed their regulations to prohibit people from doing that.
its up to the site and the regulations of the site.
if I were you I would just ask to be given credit for the car.
maybe get a discount.
and whats wrong with a picture of your car? its not like everyone doesn't see it on the road every day.

so if you can find what website they got your picture from, and then if the websites rules say you cant download pictues then they are breaking the law.
if the website says that users can download pictures... well youre sol.
