Where I'm from here in the rust-belt we call that "rust-free" and it's totally acceptable description from the seller. Like the other have said - that is simply surface rust and nothing to worry about. Unless the car was at the bottom of a lake or something, you can easily get 5 or more years out of it before rust starts becoming an issue.
