RX300 transmission service

Lexus Champion
My trans crapped out last night. 2000 AWD w/89k mi. and in beautiful condition (I've certainly paid enough to keep it that way). Is it worth $4700 to put a factory refurbished trans in this car? The service manager told me Lexus won't cut me any slack even though it's only 9 months out of the Lexus Certified Pre-Owned warranty, and it has always had dealer service since day one. Does anybody think I could get some relief if I knew where to escalate this to?
The worst part is, I had a weird surge last week and took it into the dealer to check it out - told him I thought maybe the parking brake was stuck as it cleared up after I pumped it on & off a few times, but specified to please check the drivetrain too. Asked him afterwards if they checked the drivetrain & he said it was OK. Five days ago. Of course the receipt just says "ck brakes". grr.
I researched likely problems with the car when I bought it in '05 and found out about the engine sludging, but since it had 100% dealer service and a Lexus Certified Preowned warranty, I figured I'd be OK. Apparently the transmission problems developed since then, I guess I should have been paying more attention. Sigh. What else am I missing?
The ToyoTechs article says the filter screen gets sludged up, my service mgr said there is no filter. Anybody know for sure?
Thanks!

It started whining, then slipping, then it wouldn't move at all. Dlr said they were barely able to drive it into the bay this morning (I had the tow svc drop it off in their lot last night), which is more than I expected.

Having all dealer services and being just out of warr. you dealer should have already helped you!! call 1 800 25 lexus -- give them some input on your
"service" ....Its wrong... I would expect a 50/50 deal at the least.

Problem is if you get a 50/50 deal from Lexus, you are still paying what an independent shop would charge and getting a shorter warranty peroid. This would be ok if the transmissions being used by Lexus had a good track record, but they don't. Whoever they are using to rebuild them is doing a lousy job. I just went throgh this and ended up having an independent rebuild mine.

Don't want to jinx it but so far everythings good for now.
Prob drove about 1K+ miles.
Changed the front brakes the other day. Only got about 30K out of the PBR metallic brakes that I put in last time so this time I put in OEM. Got 70K out of the original factory pads.

Thanks for all your suggestions and support. Next time I have a problem I will come here before I do anything else.
Thanks!

This thread is awesome!
We're at 165K on original transmission with no issues.
Last week the Toyota dealer near my job suggested the flush service using the machine for $295.00.
Told them no thanks after reading this thread.
