need advice on speeding ticket
A new york state trooper gave me a speeding ticket doing 80 on a 65. He failed to write the write info such as he put that my car is black when it is white, also he put the wrong plate he confused the letters. He also kept asking me about some guy in a black x5m that kept wanting to race me when I didn't know the guy because I had my car on cruise control on 65. What do you guys think do I have a change on winning I plan on taking my registration and pictures of my car showing how is white and the write plates. He also gave me a rear window tint but didn't check the percentage what do you guys think and was the best way on beating this,

before that happens they will ask you to plead guilty for $100 fine and 3 month good driving. Say no to that as i am not guilty.
goodluck hope everything works out for you...
I had a ticket for expired tags (I forgot to put new ones on). Cop gave me ticket and it had the wrong color. Wrote letter and it was dismissed. I'd suggest you go with the cop being confused as you were on cruise control but there was a black car trying to race you. Black and white are completely different colors. GL

Are you saying you had the cruise on at 65 when you got pulled over ? If so, there seems to be sufficient discrepancies in the identification that you should get off. When the state attorney asks you if you were travelling at 80 on that road that day, just say "no, I had the cruise control set at 65, I think he had me mistaken with somebody else"
I would not mention the errors in the ticket too early though. I have read that if there is an error in the ticket, the cop can sometimes simply right a new ticket. Sorry, but I can't quite remember under what circumstances he can do that.
If you were travelling at 80, then be a man and just admit it.
I think you are a gonner on the window tint though. There is a chance the judge throws it out with the speeding ticket.

A cop writing a different ticket later then the one both parties already signed sounds like exhibit A for "case dismissed" when shown to the judge alongside the original ticket. Maybe it's different in NY.
A speeding ticket is a moving violation and is issued to the driver so only the driver infromation and the infraction need to be correct. Any other mistake is not an automatic dismissal. The ticket backs up the officer, not the other way around.
A parking ticket is issued to the vehicle and not the driver so all the information on the car, place and type of infraction must be correct. You are directly fighting the ticket in this case so if the ticket is wrong, you win.
Don't go in with the attitude that the cop was wrong or out to get you or an idiot or that you were really doing 65 because that's what you had your cruise control set at. 15 mph is a big difference and cops don't just write you at 85 just cause. Judge isn't going to by that at all.
As for the tint ticket, he doesn't have to really measure anything at all. Almost all tints are pretty much illegal. The best thing you can go is go to the shop you had the tint installed and ask them for a 'tint removed' receipt showing you had the tint taken off (of course you didn't) and bring it to the judge. They will usually reduce or throw it out. (And this may help you with the speeding ticket because it's showing the judge that you learned from your mistake and corrected the problem)
