Default Credit or Deduction

Can someone please clarify something for me? Is the $25,000 a tax credit, or is it actually a tax deduction? I don't see how anyone would not buy if it were really a tax credit; and if it is, I wish I would have known at the end of last year. As for the deduction, are you only able to deduct up to $25,000 on the new purchase, rather than deduct the whole purchase amount over 5 years like we were able to do in the past on an SUV over 6000lbs GVW?

Josh, not sure if this answers your question....this is a copy & paste from the e-mail Sewell Lexus sent me in December:

The 2008 Economic Stimulus Act may just stimulate your decision to place a new vehicle into service before the year is out.

The 2008 Economic Stimulus Act increases the limits of a 179 deduction for eligible new truck purchases placed in service by December 31, 2008. Which means, you can now receive a $25,000 deduction on many. Contact us for a complete list of eligible vehicles.

BONUS DEPRECIATION.

You may be able to take an additional first year special depreciation allowance on certain eligible purchases. This allowance is an additional deduction of 50% of the property's depreciable basis.

SAVE MONEY.
You may benefit from the 2008 Economic Stimulus Act. And of course, add to your business capabilities. Come in before December 31, 2008 and let us help you make it happen. Also, be sure to consult your tax professional for details.

Thanks Zep, it does help quite a bit. It appears it's just a deduction and not a credit. Like I said, if it was a tax credit and not just a deduction, I can't see anyone not buying if they have a business. But I am still curious if the new tax law allows you to deduct $25,000 the first year and then depreciate the balance over the next four years or how exactly it works.

Sorry if this hijacks the thread, we don't have to go any further on it.

Josh...here is the e-mail we got in Nov 2008 from our accountant concerning my brother and I purchasing new "company car" 2009 GX470's.

Terry, We already figured the additional depreciation on your 2009 Lexus purchased in Nov '08. On your Lexus we took the allowable $25,000 Section 179 deduction and it will also qualify for a 50% write off of the remainder. Then the rest (about $7500) gets regular depreciation. So you’ll get about 80 – 85% write off on the acquisition. That’s why I said that even if you have to finance it for a short period it will still be a good deal for Mark to get a new one this year.
