From the looks of it, you have at least $3000 in dameges. You need to get a police report. Most insurance companies (unless you have something like State Farm) will not cover any dameges without it. And three grand is not exctly pocket cash. Good luck and sorry to hear about your missfortune.

Sorry to hear about your accident. I've had that happen to me before (cops not taking a report down - texas cops suck!) same thing they told me. So you really just have to battle it out for yourself and best thing is DO NOT contact your insurance company! What for? it wasn't your fault and you don't want any flags going up on your insurance! This looks like it's going to be a he said she said deal. If i was you, i would get an attorney so he can battle this for you, most attorneys will not ask for a payment unless you win the case (33%). Hope everything goes good!

I called the Grand Prairie police today. They said it is department policy, and Dallas county policy to not take a report if no one was hurt, or if the cars had to be towed. They also said most of Texas is the same way. They used to have a $500 rule but not anymore.

basically i learned it the hard way too, if no one is hurt, cop care less about what happened to the car. so what's my conclusion? if it's a bad accident, claim that you are hurt on the neck or something... force the issue.... i have had enough with them.

and judging from the pics, you might be ok. looking at the bumper, it's pretty obvious that the other car was going faster than you got hit, that's why the bumper was pushed forward. if you changed lane and hit someone, the bumper should be pushed in towards the front wheel

that's a terrible situation. If I were you I'd involve the insurance company. the cost and time of skipping insurance and getting a lawyer by yourself is generally more expensive to you than not. Further, if the guy countersues you, the insurance co won't be there to help because you didn't involve them. Your insurance should pay for their own lawyers to go after the guy if he doesn't pay up or if his insurance doesn't pay up.

you definitely have over $3k damage (at a reputable shop), and I wouldn't be surprised to see something in the neighborhood of $5k. One complication is that you have mods and whether or not insurance would only cover OEM material.

If the cop didn't take a report, then my suspicion is that a witness won't play into this. Even though there is no police report, there has to be a record of the cop being called out to an accident. So I'm sure your insurance company will figure it out.

Good luck.
