A Westchester County car dealership has agreed to pay restitution to customers for misrepresenting sold used cars, the Attorney General's Office announced Monday.
An agreement with the state Attorney General called for JM Hyundai in New Rochelle to pay $90,246 to customers who unknowingly purchased cars that had previously been used as rental vehicles, a violation of state vehicle and traffic law, the Attorney General's Office stated in a press release.
On April 23, JM Hyundai sent out checks to 75 customers for 10 percent of the purchase price in addition to $22,500 to the state in penalties.
Edward Barra, 47, of Wappingers Falls received $1,300 in restitution from JM Hyundai. After his October 2008 purchase, he suspected his used Sonata had been a rental when he found an Enterprise Rent-A-Car receipt in the glove box, he said.
"I live by a handshake. Just be honest. If a car is a rental, let someone know," he said.
Several messages left for JM Hyundai's general manager were not immediately returned.
Andrew Cuomo's office has also reached an agreement with Legacy Infinity, Nassau County, for misrepresenting used cars for sale and now-defunct Middle Country Motors in Centereach, Suffolk County. Middle Country Motors failed to refund thousands of dollars in deposits for vehicles that were never ultimately sold, Cuomo's office said.
The JM Hyundai and Legacy Infinity cases were handled by Cuomo's Poughkeepsie Regional Office.

wow, I used to work for a dealership and when we checked in used cars i knew a few of them were rentals mostly from enterprise. Most of them were hyundais, I didnt know it was illegal to sell rentals at dealerships?

So if someone bought a year old rental car, used it for 5 years, then traded it in to a dealership, does the dealership still have to state it was once a rental car? Or, only if they are buying the cars straight from the rental car company or auction? At some point a used car should just be a used car no?

personally, i think caveat emptor should rule this one....if you weren't interested enough to look into it, then you probably don't care enough anyways.
think about it like the carfax/car fox commercials.
the above is under the assumption that the buyers were not lied to or deceived, of course.

No one wants a rental, sure most people beat the hell out of any car, new or used, but they still don't want a rental.
I know of a few people who bought rentals, they are usually base models, a year or 2 old with 30-60k and the dealers selling them gave the owners 150k warranties, added protection of just if something cause it was a rental

Does it vary by state? Like CK6Speed mentioned, what if the car is owned by someone else and then traded in, is it still sold as a rental.
