First to tell them in no uncertain terms that you will need a rental car for 7 days at minimum after you reach a signed settlement and if that is not approved you will contact an attorney as they are not acting in good faith. Be sure to use the words "acting in good faith towards an equitable settlement".
Second is to request a minimum of $2,500 as compensation for the pain/suffering as well your as time and work involved in replacing the car and dealing with this accident. Any less than that and again you should consult an attorney.
The idea is not to profit from an accident, but you do have to play a certain amount of hardball to come out of it financially intact and not get screwed. By law the insurance company can be forced to make you whole. The law requires payments that will return you to 100% of the condition you and the car were in 1 second before the accident. They will resist doing so because they want to pay as little as possible and they usually get away with it because most people give up, take the low ball estimate and go away. You will likely have to sue or at least threaten to sue to get anything approaching an equitable settlement.

jab,as you know the insurance business is very good at short changing people when they are in a bad situation after a crash.no car and most people take what they are offered just because they need a replacement vehicle.if there wasnt and injuries its just property damage.
its to bad there isnt a go to manual that explains what to do if you have been in a crash.im sure it wouldnt come from the insurance co.

Your 2004 with 105k and UL is likely worth much more than that adjuster said.
Our 2004 with 120k had $14,500 damages last January
We did search for 8 counties in S. Calif. For comparables
We did adjusters job for him.
Adjuster wanted to total it and close the file but we did not play with their game
Make sure if it is repaired you can insure it and have the repairs guaranteed for time you own it
Here a lawyer friend consult helped us he has auto arbitration specialty
Glad no one was hurt...that can be restated to adjuster to get him to play fair...imagine if injuries...

if it were me, i wouldent even want that LS back. as soon as i see the rear quarter panels in that condition i get night terrors where no body lines or roof lines line up.

Anyway, I got a decent offer today so I'm out looking for a replacement. Anyone have a line on a REALLY SWEET, low mileage, 2006 LS430? I don't think I want the UL package this time.
I had to jump on the adjuster pretty hard and point out the folly in the comps they used to come up with a valuation. I actually went and looked at a couple of the comparables. What an eye-opening experience that was. Does anyone take good care of a vehicle anymore? Does everyone purposely curb their rims?

It does have an accident report but at only 9500 miles. Probably minor. I would not be afraid of a car because of an accident report. Mine has one now after the bumper was replaced when someone backed into it in a parking lot. Very minor damage that was replaced with all oem parts. Good as new.
