Default Lemon Law applicable?

Hi,

Just curious, does anyone know if the Lemon law (for Washington State) could be applicable if the dealer is unable to replicate a problem where the problem can be recitified under TSIB?

The one I may be thinking of doing is the instrument/dash rattle/crack since my vehicle has this problem. I originally brought my car in for service to have them look at it but they said oh they were unable to reproduce the problem and to bring it in if it happens again. The reason at the time is because it was raining so they could not test drive it since it will make it harder to hear. I was actually in disbelief when I heard that since the problem can be heard regardless of the road conditions.

Since the problem with this is random, they maybe unable to reproduce again if I were to bring it in and do not think it is worth my time to bring my car in unless they can fix it.

If it cannot be addressed, I would think of using the lemon as a last resort.

Your advise is appreciated.

I'm not sure of the details but something is telling me that the car has to be in the shop x amount of times for the same issue, with them trying to fix the problem with no success.

I doubt a dash rattle would qualify the vehicle as a lemon, regardless, I'd think that your best bet is to call Lexus USA and speak with them before doing much else.

Oh yes, I have look at the link before but was not sure if someone who is very familiar with the lemon law knows if it could fit in any of the categories in there.

I am considering talking with Lexus USA about it because it is going to be a pain to have them diagnose it since it is heat related and whenever it happens, it may not happen when it is in service.

I was lucky with the cam gear where it would make the noise during start up and service just went ahead and did the repair based on my description and reference to the TSIB without diagnosing the issue.

Definately do not want to get rid of my ride, but if cannot be done I'll see what can be done to switch to like a new IS which does not have the problem.

They probably just need to add more insulation around the instrument cluster. I had a squeak in the same area and my dealership said it was a common problem and easy fix. I was also able to reproduce the noise by squeezing the top of the gauge cluster and top of dash together.

Maybe you should try another dealership...

I brought my car in for the same issue when it was raining and my dealer offered me a loaner vehicle so they could diagnose the issue the following day when it stopped raining.

I talked with a dealer in Lexus Canada. They said they will go ahead and do it because they have seen so many IS’s with the same problem that it is redundant to go check on it because it is the same problem. I will see what US said since if the dealer in Canada can do it, US should too.
