If you don't have another $10K available for potential repairs you're kidding yourself. Repairs can be ridiculously expensive and simply not worth it on older models. There are much better options out there than paying for a badge.

Please put your money to better use. Think about it! your looking for a 10 year old german luxury car with no problems.
Either save more money or look for a Japanese car or either downgrade your expectation.

Now here is a real alternative. Go buy a Lexus IS300. Find the best maintained example you can for $10,000. That car really should not give you any sort of grief, yet it will deliver that sort of 3 series BMW driving experience/handling.
The trick is to find something decent for $10,000. My one requirement was a MANUAL TRANSMISSION, I could not find **** in the market for used IS300's with a manual transmission. They all had 100k+ miles, or were ragged out. I ended up settling on a MINT 1992 SC300, same motor, manual transmission, 61k miles, for $8900. Really the only reason I paid that much for a 20 year old car was that it was in just damn perfect shape, really I've seen 2011 or 2012 cars that aren't this clean.

I agree with the IS recommendations, but also look at the Infiniti G-series. They offer generally good reliability, more back-seat room than an IS, early-production AWD (G35X) availability for bad-weather, and as much or more depreciation than an IS (meaning good used-car prices). But you may not like the (by luxury/premium-car standards) so-so interior and mediocre paint jobs on the early-2000s G35 models.....significant improvements in both arrived a few years later.
