Can i sign a car title that's in someone else's name?

Default Can i sign a car title that's in someone else's name?

Hello, new member here. I have owned my 2008 ES350 for quiet a while now. It was purchased new and i've enjoyed it ever since. However, I fell in love with the all new ES and i want to sell my current ES. However, the title is in my brother's name. We had to purchase it under his name because of my bad credit history when i was purchasing the vehicle... Problem is, my brother is out of country (in the army) and won't be back anytime soon. I was wondering if its ok for me to sign the car over to the new owner? Or is this something that can come back and bite me in the ***? Like void of transaction for whatever reason the new owner wants his money back? Any advise would be much appreciated. Thanks in advance!

Probably not. You and your brother would likely need to fill out a power of attorney form, notarized, etc

no, do i need to have my brother present to do that? Or is this something i can have done after selling the car and my brother comes back?

man are you going to open up a can of worms,dont even think of selling it with out a power of attorney.

Reason why im asking all this is cuz there is a person who is willing to buy the car immediately... I guess best thing to do is to mail the title to my brother and have him sign it and send it back to me. Thanks guys!
