Kewl, thanks for the info guys. Just got rear ended yesturday right after I posted this thread. The sad thing was no one is at fault so I have to come up with the money to get a new bumper(don't want to use insurance). Steve already quoted on a new bumpter. Thanks for info again.

how is it possible that you got rear-ended and no one is at fault

idk about cali, but in NJ, if you are rear-ended, the person who hits you is AUTOMATICALLY at fault...

did you file a police report?? if so, the insurance company will stil get the police report since all your insurance info is on the police report. good luck.

I thought that if you rearended someone it was automatically your fault. What if you cut someone off and they rearend you becuase of your carelessness. Whose fault?

Ok my bad, let me explain. I was in this really busy shopping center backing out of a stall. There was a big SUV to the right of me, and an island to the left of me. There was a lady to the left waiting to pull into my spot. I started backing out and then all of a sudden, this lady in a red nissan pathfinder with big tires comes zooming thru and swips my rear bumper with her tire. She didn't even know that she hit me. She kept driving...I had to go chase her down and let her know that she had just hit my car. I talked to my friend who is an insurance investigator and explained to him what had happened and he said these types of cases are tough to figure out who is at fault. Even though I was more than a quater out of the stall and the lady wasn't paying attention, it would be tough to prove either one. My friend said that most of the time, the insurance companies will just split the fault 50/50. If anything, there will be a 1 percent chance that it is my fault because I was backing out of the stall... it would be hard to prove the lady was speeding. He said that I should just eat and that these things happen all the time.

ah.... you are very right mike, sorry to hear that but it's probably more likely to prove you should be passive than she was speeding. sorry
