I don;t know if your insurance allows you access to a claims specialist, but a member of my family told me ( insurance agent) when this happens they usually send someone out to look at the damage and they can tell who was at fault based on the damage.

Basically they should be able to tell they are lying by the paint transfer and scratching.

I am actually going to call my insurance today, not my agent, and ask them a general question about it. Like if they actually look at the pictures and break it down or perhaps have someone to look at the damages in person. I really do feel as though not much has been done to determine fault. I mean if the position I am in now was ultimately how it was going to be in the first place, then insurance would be pointless, claim pointless. Crash and go.

thats some ****in bull****.. people dont ****in back up.. morons.. that **** happen to me when i got my whole car painted... here is my story..
a week after first time drove the car to a meet. on the way back i decided to get some food.. so i do int he drive through and i see the window ahead, then there is a car in between the window and the ordering mic thing with the menu.. i pull up to the ordering thing.. as im ordering i see reverse lights come on.. i had no horn but its night time and my lights are on.. so i scream out the window " YOU ****IN IDIOTT!!" boom i get out and start yelling at this kid.. some chick in his car too.. he starts crying and im just yelling" are you a moron" why would you back up in a drive through if you are not buying anything just drive through it you idiot" his gf gets out and is like stop yelling at him and i was like get the **** in the car.. nothing else from her.. got his insurance info and said you are ****ed this car is fresh out of paint..
and i took a pic of his license and got insurance info..
called his insurance and was like this person backed into me in a drive through.. any ways a week passed and i kept calling the insurance.. they were like we are trying to contact them. i was like bull**** u r taking too long. i was like **** this.. so i got a buddy of mine and we showed up at the address on the kids license.. mexican parents answer door.. "is this your son".. yea.. well he hit my car.. omg he didnt tell us.. apparently the kid was getting the mail and phone calls to avoid insurance.. dad was liek ill pay you dont tell insurance.. i was like u cant afford this.. he was liek i have a friend that can fix this for cheap.. i was like hell no its a freshly painted car.... then he says well its not even bad its not that noticeable.. the under coat was spiderwebbed.. i was like it should be flawless its a freshly painted car.. any ways long story short i got a 1700 dollar check from his insurance just for my front bumper. LOL

Its your word against the old man's, unless there is a witness.

You can leave a message for the cop and see if he responds.

You can pursue and Judge can issue a subpena for the video evidence (assuming it captured something and the tape is available).

Your insurance sends a 'they mean business' letter demanding damages to be paid or they will pursue through court system and get video evidence.

Karma has ways to catch up.

Sorry to hear about this unfortunate event some people have no integrity. I guess just make the best of it and be happy your young and driving a clean SC while he's old and driving of POS ranger.
