time to time I read about "claims" in forums without a proof or actual ownership of a vehicle.

What was in the letter from Lexus legal department? What were their findings?

How far was it from where you parked to whatever it hit. Some major damage.

Was parked about 40 to 50 yards up on hill, then landed in shrubs and hit few small trees. Car is totaled. Lexus will send a letter in findings in 30 days.
I have a Range Rover sport and Tahoe, that I park on hill without E BRAKE and never had an issue. Those cars are heavier.

I'm not familiar with how Lexus conducts an inspection. Do they do it on-site or is the car hauled off to a dealership or hauled off to some Lexus lab somewhere to be dismantled?

they flew some one in from california, didn't do much testing, hooked computer up I think. Didn't put it on a lift or I dont think they even personally looked under the car.
I wasn't with them. They wouldn't give me a specific time or date when they were coming to check car, I was skeptical why they wouldn't.

If the car was still on, wouldn't it be possible that someone put it on neutral while you left? Did you lock the doors when you walked away? You can lock the doors using the key but not the fob.

well the car has a black box that records everything prior to the crash. I am sure they will be checking that

Mr whoever you are, I just have to ask. You parked your Lexus in park (you say) and did not engage the parking brake. And you speak of doing the same with your Range Rover and Tahoe. Is there some advantage you're aware of that I'm not re: NOT using the parking brake ??? Maybe I'm wrong, but I always think it's best to always use it. Just because you got away with it once doesn't mean you always will. It's like seat belts. Some people still refuse to wear them because the wreck they were in w/o wearing them didn't injure them. I betcha the next wreck is gonna smart .

If you insurance provides you w/another car are you going to park it the same way you've been doing. Sorry but if it was me I'd have never smashed enter on the 1st post.

It's not that hard to figure out, it the park mechanism is functioning inside the transmission you forgot to put it in park. If the park mechanism has failed you have a case.

It didn't magically roll down hill with a working park.

I am also interested in what Lexus say about it.

I rarely leave my car running. One exception is if I am working on the engine and I have to test something while its running. Always engage the emergency brake and point the front wheels toward the curb. If you do that you will not have any problem. I strongly suggest you do that to your other two cars.

I went to your Facebook link and read the comments there. Apparently Lexus legal department has responded to you thus:

"We looked into your incident a little bit further and found out that our legal team has mailed you a copy of their findings after your vehicle was physically inspected. If you have not received this document yet please contact our Customer Satisfaction department at 800.255.3987 option #3. We apologize for any inconvenience this may have caused. Thank you, Michael L., Lexus Customer Satisfaction."

I am interested in what they said.

good luck... i don't think it was too wise also to post your pic on Lexus official facebook page. If you were found at fault, they might say you are trying to defame them.
