Yes and no, it doesn't help if they file a lawsuit. However they can just go the next day, also if asked say they were still dazed from the accident. I have a love hate for lawyers I hate when I am going against them, however when they are fighting for a "legit" wrong done to someone I am for them.

The old man who was involved in my TT 350z wreck received an additional $80k from my insurance company for Post Traumatic Stress. He had no physical injuries. He said that every time he seen a sport bike or a 350z he got so upset that he had to pull off the road (I was racing a sport bike when the accident happened). The only injury was from a friend in my car who had a herniated disc in his neck, he only got $15k.

If I ever get hit I know that I'm going to have post traumatic stress.

It sucks now, back in the day hey sorry my fault, let insurance fix your car and you go on about your day. Now everyone is looking for the quick payday, I hate to see what happens 20 years from now.

You're Exactly right, the old lady that spilled that McDonald's coffee in her lap started it All! Actually, it's the Liberal Judges that's letting them get away with those Frivolous Lawsuits
