Angry LS back from Shop with Different Issue, Legal Options?

Okay guys,
had my LS's Water Pump, Tensioner, Timing Belt, Fan bracket and all that Jazz replaced at this shop.

my post is here

Got it back and the guy said I needed a tune up. Great!
So I changed the Wires, Plugs and Rotors with Denso all the way.
I put her back together and still running like **** and getting a code 13.

My other post is here

So I yanked the Cam and Crank sensors, check the resistance. All is good. I wanted to make sure I wasn't on crack, so I took them down to the Lexus Dealer and checked them against brand-new parts. Same reading.

I put her back together for the 3 time and drove it to the place that did my timing/water pump. They have had it for a week and in two shops and are telling me that the timing is good and that I could send it somewhere else to get looked at but if it aint the timing they aren't responsible.
WTF!

I didn't have any codes going in the shop so why am I responsible?

I asked them if the belt had the wrong amount of teeth.
I asked them if they checked the timing - well duh?!
what next? TPS?

Any legal recourse available? OR am I SOL?

I've got a manual on CD and all points to either the sensors or timing which I/they say are good.

What next?

What kind of compression are you getting from each cyl? The coil packs are working otherwise, you'd have more issues than with just those two cylinders.
When I had the BMW, I had oil fouling the plugs...ran like crap. Is the valve train for those two cylinders ok?

Code 13 is an RPM signal malfunction. There is a variance of signals from crank and cam position sensors.
I have seen timing belt installations go seriously wrong when performed by less than competent individuals. Most common mistake is not getting the cam position sensor wiring harness back in original position and the accessory belt cuts it. Look at accessory belt closely and see if it is touching either cam position harness. You can check cam position sensor and crank position sensor using multi meter. You should have 850 - 1350 ohms resistance for all three sensors.
If sensors check ok it has to be timing belt one or more teeth out of timing.

Good luck

His first link.
Didn't look at his profile data.
I see he's received a response for the code error.

Default yeah

Yeah the sensors are good. I took them out and checked them myself after I already did my tune-up the week before. Rotors included. I quad-druple checked the paths on my wires too.

This whole deal is a big ka-Blewey.

I am so friggin mad over this issue. Dont get me started. I ended up towing it to a Toyota Guy over the state line and he got it done in 3 hours. He said and I quote;

"The timing belt was off two notches"

Oh and that other shop. Dont go there. "we had two other shops look at it and they couldn't find what was wrong with it..." waaaa waaaa waaaa
Anyone in Charlotte NC or Concord NC or near here at all, PM for the name of the jacked up radiator shop that did me wrong.

I am taking this isht to the top. Ha ha!
Straight to the Credit Card Company and having them pull the charge back until those peeps can pay the bill for the car.

I told them - I told them - I told them it WAS THE TIMING!!!

I was right.

Thanks to all the CL and LOC peeps for the Knowledge.
Now to go and fight those sheisty bastards.
